How do I get emergency full custody after my girlfriend's arrest?

My girlfriend lives with me. This morning she called the police twice and was jailed for shoving a door into my back while holding our 9‑month‑old daughter. She takes our daughter everywhere, never tells me where she’s going, and spends hours with unknown people. She refuses to leave the baby with me or pump milk so she can stay home.

I have a court date.on September 9 for PA, custody, and support. I’m considering seeking full custody now. She has nowhere to move and will probably lose her nursing job. What do you think?

She lives rent‑free in my home, pays no bills, and doesn’t buy groceries, diapers, or wipes. She works at most two days a week and often calls off; I buy all clothes and necessities. This is my first time dealing with a situation like this and I feel lost. I don’t want her to get out of jail and try to take our daughter. Police told me to contact my lawyer and request an emergency custody hearing. What do you think? Any advice? Anything will help now.

Update: She was released, returned, caused a scene trying to get her belongings, and police were called again. The state served her an order of protection, yet she forced me to hand our daughter to her. How is this fair? If it were me, I wouldn’t be allowed near either of them again.

I have no criminal record, own a landscaping business, am well known in town, and am a USMC veteran.

I don’t have much to offer beyond the urgent need for you to find a lawyer right away. I truly can’t understand how she could have your child when she has nowhere to go and has just been released from jail it simply doesn’t make any sense.

Step 1: file a DVP, then request an emergency hearing with family court for full custody until the full hearing is set, and get a lawyer. That’s your best bet. 👍

You need to file for an EXPEDITED hearing for physical custody. It shouldn't be hard, given the current situation. She sounds like she needs help, but her present behavior makes her a dangerous person for your child to be around.

I would also file a complaint with the department, and I would look into a welfare check as soon as possible. I can’t believe that, given the situation, they’d ask you to release your child to her, even if it’s just short of feeding.

A cop can't decide that I believe its gotta be a court that makes that call.

I would call CYS inform them of the situation and go from there.

I’ve been through this too, so I’m really sorry. Make sure you document everything and gather as much proof as you can. When my ex attacked me, I recorded it on my phone, which helped the police and got me a protection order. If you take this to custody court, they’ll probably side with you since she has a domestic‑assault charge involving your child. Have your attorney get the case number and use it against her. Also, at the emergency cutody hearing, the judge will likely grant you more maybe even sole custody until the full custody hearing. Contact your attorney ASAP, trust me.

Restraining order is your best bet I think

Don’t be nice. Don’t repeat my mistake. I gave my ex time to get her act together. When she finally did, she took my kids and alienated me. I had to prove paternity and secure 50/50 custody, even though I could have gotten full custody.

Other than hiring a lawyer:

Record every expense for the child and log the time you spend with the child before and after this episode.
Stay home; don’t leave the house.
Communicate only via text or email no in‑person or phone contact. If something is said face‑to‑face, write it down, text it to her, and get her confirmation.
Stay strong you’ve got this!! Be the gray rock to her shenanigans, get her moved out, and line up childcare and any other assistance you need.
